3) Estimates, Scheduling & Cancellations
- Estimates: Quotes are based on information available at the time and may change after on-site inspection. We will communicate material changes before proceeding.
- Scheduling: Appointment dates/times are subject to change due to weather, safety, equipment, or staffing. We will notify you of any changes.
- Cancellations: Please provide at least 24 hours’ notice to cancel or reschedule. Missed appointments or short-notice cancellations may incur a fee.
- Access & Preparation: You are responsible for providing safe access to water and electrical outlets (if required), securing pets, and removing fragile items/vehicles from service areas.
4) Website Use & Intellectual Property
All website materials—including text, graphics, logos, photos, videos, icons, and code—are owned by us or our licensors and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without prior written permission. Limited personal, non-commercial viewing is permitted.
5) User Content (Photos/Reviews)
If you submit reviews, testimonials, or project photos, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display such content for marketing, portfolio, and service purposes, in any media, with the right to adapt for formatting. You represent that you own or have rights to the content and that it does not infringe others’ rights. You may request removal at any time and we will act within a reasonable period.
6) Payments & Invoicing
- Invoices are due upon receipt unless otherwise stated. We may require deposits for certain jobs.
- Payments are processed by third-party providers; we do not store full payment card numbers. Fees for late or returned payments may apply.
- Unpaid balances may result in suspension of services and collection activities as permitted by law.
7) Property Condition & Service Limitations
- Pre-Existing Conditions: High-pressure or soft-wash services can dislodge failing paint, oxidized coatings, loose mortar, compromised seals, or damaged substrates. We are not responsible for damage arising from pre-existing conditions or hidden defects.
- Delicate Surfaces: We may decline or modify methods on sensitive materials (e.g., certain roofing, aged wood, oxidized siding, loose stucco). We will discuss options and obtain your approval before proceeding.
- Weather & Safety: For safety, we may pause or reschedule due to wind, rain, lightning, or unsafe site conditions.
- Water/Electrical: You are responsible for adequate water supply, functional spigots, drains, GFCI-protected outlets (if needed), and for notifying us of any known issues.
8) No Warranties
EXCEPT AS EXPRESSLY STATED IN A WRITTEN SERVICE AGREEMENT, THE WEBSITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. RESULTS MAY VARY BASED ON SURFACE CONDITION, WEATHER, AND OTHER FACTORS.
9) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, OR REPUTATION HARM) ARISING FROM OR RELATED TO THE WEBSITE OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.
10) Indemnification
You agree to defend, indemnify, and hold harmless the Company and its owners, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the website or services, your breach of these Terms, or your violation of any law or third-party right.
11) Third-Party Links/Tools
Our site may include links, embeds, or tools from third parties (e.g., maps, review widgets, video players, payment processors). We do not control and are not responsible for third-party content or practices. Your use of third-party services is subject to their terms and policies.
12) Privacy, Cookies & Accessibility
Your use of the website is also governed by our Privacy Policy and our Accessibility Statement. We may use cookies and similar technologies as described in the Privacy Policy.
13) Communications & SMS Consent
By providing your contact details, you consent to receive service-related communications (e.g., estimates, scheduling, job updates). If you opt in to SMS, you may receive text messages; message and data rates may apply. Reply STOP to opt out of marketing texts. Transactional messages may still be sent for active jobs.
14) Governing Law & Disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Venue for any permitted court action shall be in the state or federal courts located in Ventura County, California.
Informal Resolution: Before filing a claim, both parties agree to try to resolve disputes informally by notifying the other party in writing and allowing a 30-day cure period.
Arbitration (Optional): To the extent permitted by law, either party may elect to resolve disputes (other than small-claims matters) by binding arbitration on an individual basis. If elected, arbitration shall be administered by a reputable provider under its consumer rules, and the hearing location shall be Ventura County, California.
Class Actions: Proceedings must be brought in the parties’ individual capacities, not as plaintiffs or class members in any class or representative action.
15) Changes to These Terms
We may update these Terms from time to time. The “Last Updated” date reflects the most recent revision. Continued use of the website or services after changes become effective constitutes acceptance of the revised Terms.
